Terms of Service

Please read these Terms of Service ("Terms") carefully before using Asyar. By downloading, installing, or using the Asyar desktop application or the asyar.org website (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Asyar is a productivity launcher application for desktop operating systems. The core application is open-source software distributed under the GNU Affero General Public License v3.0 (AGPL-3.0). Optional premium features (such as cloud sync and AI capabilities) are available through a paid subscription. The extension ecosystem allows third-party developers to build and distribute extensions through the Asyar Extensions Marketplace.

2. Accounts

You may use the core application without an account. An account is required to access premium features or to publish extensions to the marketplace.

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account and all activity that occurs under it.
• You must provide accurate information when creating your account.
• You may not share your account credentials or use another person's account without their permission.

3. Subscriptions and Billing

Some features of Asyar require a paid subscription. Subscription terms:

• Subscriptions are billed on a monthly or annual basis, as selected at checkout.
• Subscriptions renew automatically unless you cancel before the end of the current billing period.
• You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.
• We reserve the right to change subscription pricing. We will give you at least 30 days' notice before any price change takes effect.
• Feature entitlements are tied to your active subscription. If your subscription lapses, premium features become inaccessible but your data is retained for 90 days.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Reverse-engineer, decompile, or attempt to extract the source code of the proprietary backend systems (the open-source desktop application is exempt — you are encouraged to read and contribute to it)
• Abuse or overload the API beyond reasonable use
• Submit extensions to the marketplace that contain malicious code, spyware, or that violate users' privacy
• Impersonate another user, person, or organization
• Use automated tools to create accounts or interact with the Service in ways that circumvent intended usage limits

5. Extensions and Third-Party Content

Extensions published in the Asyar Extensions Marketplace are created by independent developers and are not officially endorsed or reviewed by Asyar unless explicitly marked otherwise.

• You install third-party extensions at your own risk. Asyar is not liable for damages caused by third-party extensions.
• Extension developers are responsible for ensuring their extensions comply with these Terms and applicable laws.
• We reserve the right to remove any extension from the marketplace that violates these Terms or poses a security risk.

6. Open Source

The Asyar desktop application and the Asyar SDK are open-source software distributed under the GNU Affero General Public License v3.0 (AGPL-3.0). Your use of the open-source components is governed by that license. These Terms of Service apply to the hosted services (asyar.org website, API, cloud sync, extension marketplace) and not to the open-source code itself.

7. Intellectual Property

The Asyar name, logo, and website design are the property of Asyar. Nothing in these Terms grants you a right to use the Asyar name or marks. User-generated content (such as extension code you author) remains your property — by publishing it to the marketplace you grant us a non-exclusive license to display and distribute it through the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASYAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting us or using the account deletion option in your settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will do so.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will notify you via email or a prominent notice in the application at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
